Giant Collection: Terms and Conditions

The following terms & conditions apply to those volunteering in the St John Ambulance Giant Collection and I accept that, by registering my interest to be part of a St John Ambulance Giant Collection event, I agree to these terms & conditions. I confirm that I have read these terms & conditions carefully and agree to fully abide by them. If I have any questions or concerns regarding these terms & conditions, I will contact the Community Fundraising Team to discuss my questions or concerns further before registering my interest.

1.I understand that, in volunteering at a St John Ambulance Giant Collection (the collection), I am volunteering at my own risk as an independent supporter of St John Ambulance and will not seek to hold St John Ambulance, their employees, or their agents responsible for any injury, loss or harm resulting from me taking part.  Any support that St John Ambulance may provide in organising the collection will not lead to St John Ambulance being liable for or having approved of any particular activity or any process involved in the collection.

2. I agree it is my responsibility to obtain and maintain appropriate insurance for volunteering at the collection, to cover risk of injury or death to myself.

3. I agree to comply with all applicable laws, regulations and guidelines in relation to my fundraising activities, including the Fundraising Regulator’s Code of Fundraising Practice and the Charity Commission Guidelines for public and static collections.

4. I agree it is my responsibility to conduct a risk assessment to ascertain whether there are any risks associated with taking part in the collection and take all appropriate steps to mitigate such risks as in my own judgment and by the exercise of my discretion I consider appropriate.

5. I confirm that I will disclose when prompted, any medical condition or impairment that may be detrimental to my health if I participate in the collection.  If I become aware of any such medical condition or impairment at a later date, I will withdraw from the collection. If I am in any doubt as to my physical ability to take part in the collection, I will consult my doctor before arranging to take part.

6. If a claim is made against St John Ambulance in relation to the collection arising out of any breach by me of these terms and conditions, I agree to reimburse St John Ambulance for any sums which it pays as a result of that claim including, but not limited to, any associated legal or other costs and expenses and to indemnify St John Ambulance against all loss whether direct or indirect

7. If requested to do so by St John Ambulance I agree to immediately stop volunteering at the collection in aid of St John Ambulance and to then immediately: 

a. Pay any money to St John Ambulance; and 

b. Stop using any materials provided by St John Ambulance (the St John Ambulance Materials) I still have and return them to St John Ambulance (or destroy them if asked to do so by St John Ambulance) and delete any electronic copies I have of St John Ambulance Material

8. I understand that I must be 16 years of age or older to volunteer at the collection.

9. I acknowledge that I am responsible for all costs and expenses incurred or arising in connection with the collection. 

 

Intellectual Property Rights in St John Ambulance Materials  

10. I agree that any St John Ambulance Materials supplied to me for the purpose of the collection will only be used in connection with the collection.  I acknowledge that St John Ambulance owns all intellectual property rights in the St John Ambulance Materials, and I will not use any St John Ambulance Materials in connection with any other activities without first obtaining St John Ambulance written approval. 

 

Personal Data and Photographs  

11. I agree that St John Ambulance may use my contact details to contact me about the collection. This includes passing on my details to registered St John Ambulance volunteers (Team Leaders) who will contact me about the collection. 

12. All personal data held by St John Ambulance will be handled in accordance with applicable data protection laws, including the Data Protection Act 2018. I confirm that I have read and understood the St John Ambulance privacy statement at Privacy Notice | St John Ambulance (sja.org.uk). 

13. I agree that if I provide St John Ambulance with any photographs or videos taken during the collection, I am satisfied that any individual appearing in such photographs or videos has been informed that St John Ambulance may use such photographs or videos and that they would have given their consent to such use. I agree further that St John Ambulance may use such photographs or videos for fundraising purposes and I will inform St John Ambulance immediately if any individual wishes to withdraw their consent or raises any objections to any photographs or videos being used.  

 

St John Ambulance Liability   

14. Notwithstanding any exclusions of liability set out above, nothing in these terms and conditions shall limit or exclude St John Ambulance’s liability in respect of death or personal injury sustained as a direct result of the negligence, breach of statutory duty or fraudulent misrepresentation of St John Ambulance, its employees or agents or any deliberate act or omission of St John Ambulance, its employees, or agents. 

15. I will not do anything that threatens St John Ambulance reputation, name or charitable purpose. I acknowledge that, in the event that St John Ambulance reasonably believes that the collection may damage its name or reputation, St John Ambulance has the right to require me to stop volunteering at the collection immediately.  

 

General Conditions  

16. St John Ambulance may vary these terms and conditions from time to time and the current and applicable terms are those available on this website as at the date of the commencement of the collection. 

17. In the event of any conflict between these terms and any other material provided by St John Ambulance in connection with the collection, the provisions of these terms and conditions shall prevail. 

18. During the collection I agree to refer to raising money "in aid of" St John Ambulance rather than on behalf of St John Ambulance as I am not authorised in any manner to suggest that I act for or represent St John Ambulance. 

19. I understand that St John Ambulance may withdraw its agreement for me to undertake the collection on immediate notice and without providing any reason for its decision. 

20.I agree to inform St John Ambulance immediately if I am no longer able to participate in the collection. 

21. I agree not to tamper or open any of the collection buckets at a St John Ambulance Giant Collection and to hand these to the Team Leader after the collection. 

22. These terms & conditions and any dispute or claim that arises out of or in connection with them is governed by and construed in accordance with the laws of England and Wales.  The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim that may arise out of or in connection with these terms & conditions. 

 

The following terms and conditions apply to those who are placing a collection tin in their local area or collecting at home with a cardboard collection box 

23. I shall pay all proceeds from the collection to St John Ambulance as soon as reasonably possible and in any case within 28 days after the campaign took place in June 2023.  All payments to St John Ambulance shall be made via debit or credit card, cheque, bank transfer or via a secure online fundraising page. I agree to notify St John Ambulance of: 

a. the date the payment has been made; 

b. the way it has been made; and 

c. the amount.
